These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Exclusive venue: state or federal courts in Miami-Dade County, Florida.
These Terms of Service (“Terms”) are an agreement between you and MD WATER LLC, doing business as The Intelligence Guide (“we,” “us,” “Company”), for use of ai.gotig.net, our AI voice and messaging software, and related Meta / WhatsApp connections (the “Service”).
If you have a signed service agreement with us, that signed agreement controls if it conflicts with these website Terms.
We provide bilingual AI tools for insurance agencies, including voice answering, WhatsApp, SMS, and web chat, and related inbox features. We are a software provider. We are not an insurance company, insurance agency, or licensed producer. The Service does not bind coverage, quote a binding premium, or replace your compliance obligations.
You must be at least 18 and able to form a contract under U.S. law. If you use the Service for an agency, you represent that you are authorized to bind that business.
You must provide accurate information. If you connect WhatsApp or Facebook Login for Business, you authorize us to access the WhatsApp Business Account and related Meta permissions needed to send and receive messages for your agency. You must have the right to that number and account. You are responsible for Meta’s and WhatsApp’s rules, including customer disclosures.
Connecting WhatsApp via the official Business API may affect how the WhatsApp Business app works on that number unless coexistence is enabled and supported for your setup.
You may not use the Service for unlawful robocalls or texts, spam, fraud, or to misrepresent your identity or licenses. You must comply with TCPA, Florida telemarketing and recording laws, insurance advertising rules, and Meta Platform Terms. You must not attempt to access other customers’ data or probe the Service except as we allow in writing.
You retain rights to your agency content. You grant us a license to process calls, messages, and related data to operate the Service. AI output can be wrong. You must review critical information with licensed staff. We do not guarantee quotes, conversion rates, or that every message will be answered perfectly.
Fees are as quoted (including any signed agreement): typically a setup fee and monthly service fees, plus usage overages where applicable. Fees are in U.S. dollars. Except where required by Florida or federal law, fees are non-refundable.
Our Privacy Policy explains how we handle information. For people who contact your agency through the Service, you are responsible for required notices (including recording and WhatsApp).
THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY U.S. LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS. Some states do not allow certain limitations; in those states our liability is limited to the fullest extent allowed.
You will indemnify MD WATER LLC and The Intelligence Guide against claims arising from your misuse of the Service, your content, your insurance customers, or your violation of law, except to the extent caused by our willful misconduct.
You may stop using the website at any time. Paid service is month-to-month after go-live unless a signed agreement says otherwise; cancellation follows that agreement. We may suspend the Service for non-payment or material breach.
We may update these Terms by posting a new version. Material changes to a paid subscription will be communicated as required by the signed agreement or by notice to the account email.
